On the afternoon of November 19, 2022, the 5th International Forum on Technology Innovation and IP Protection (TIIP), which had been long-awaited by people both at home and abroad in intellectual property, technology and finance industries, was held in Lia Charlton Hotel, Nanshan District, Shenzhen, Guangdong, China. With the theme of construction of industrial innovation ecosystem and intellectual property, this forum brought together renowned experts, scholars and industry elites. Everyone spoke freely and had an in-depth discussion on how intellectual property plays an important role in the innovation industry ecosystem.
The forum was guided by the Party Committee of Shenzhen Hi-Tech Industrial Park South, hosted by Shenzhen Enterprise Science and Technology Innovation Association and Shenzhen Engineer Association, and co-hosted by Johnson Intellectual Property Agency (General Partnership), Guang Dong Fair Law Firm, Tian Yuan Law Firm (Shenzhen), Huizhou Science and Technology Business Incubation Association, and Guangdong Kexin Business Incubation Company Limited (a national incubator).
The forum started with speeches by Ms. Ma Lifang, Secretary of the Party Committee of Shenzhen Hi-Tech Industrial Park South and Mr. Liu Wenqiu, President of Shenzhen Enterprise Science and Technology Innovation Association.
Ms. Ma introduced the work overview of the deep integration of Party building work of the District Party Committee and enterprise development, affirmed the contribution made by the intellectual property industry in the development of science and technology innovation construction, and also expressed good wishes for the success of the forum.
Mr. Liu said, under the COVID-19 epidemic situation, our original intention of serving domestic and foreign innovators and entrepreneurs has always remained the same. Moreover, in the future, we will further integrate various resources to build a newer and larger exchange platform, and strive to bring together more domestic and foreign industry professionals, so that the world can learn more about China, and also give more domestic enterprises the opportunity to go global.
In the guests’ speeches session, Mr. Guoliang Lv, a consultant of the World Intellectual Property Organization (WIPO) Office in China, shared with the knowledge of the Hague Agreement concerning the Registration of Industrial Designs and the protection of design innovation. Mr. Lv started with the increasing trend of global design applications and the protection of design innovation, which led to the Hague Agreement, the international design registration agreement. As a simple, economical, efficient and flexible system, the Hague system is of great significance to the international registration of designs. China has taken a lot of efforts to join the Hague system, and is now a party to the Hague Agreement, which enables Chinese applicants to apply for extensions and protection in their own country to other member countries or regions of the Hague system with more concise procedures and less costs. He said that that relevant enterprises can better understand and make full use of this global resource.
Mr. Guo Shizhan, a partner of Tianyuan Law Firm (Shenzhen) (formerly an IP executive at Huawei), shared the key points in trade secret management. Mr. Guo believes that trade secrets, like icebergs hidden under the surface of the sea, are of greater and higher value to enterprises than patents, trademarks and copyrights, and are also more complex. From the perspective of a participant in the formulation of the Shenzhen Enterprise Trade Secret Management Standard, he first introduced how to control the major risks in trade secret management from both hardware and software perspectives, and then, he introduced specific management points, including objectives, systems, system structure, organization and working mechanism, etc.
Ms. Liu Chan, IP director of SenseTime Group Limited, shared the IP management system of AI enterprises. AI enterprises should focus on the accumulation of patent assets, which can be accumulated through the layout of their own patents or external patent acquisition. The general principle of enterprise patent layout strategy is where the mainstream/potential market of technology is in the next 3-5 years, where the IP goes! Factors to be considered in layout include patent type and characteristics, market volume and customer demand, competitors, legal environment and costs, etc. In addition to the layout of patents, enterprises also need to build an IP infringement risk control system and handle the practical work of infringement risk control, so as to comprehensively improve the their own IP management systems.
Mr. Huang Pengfei, IP manager of HNB (Heating Non-Burning) of Shenzhen Smoore Technology Co., Ltd, introduced how enterprises should make patent breakthroughs in the process of product research and development through specific cases of electronic cigarette heaters. At the same time, he also elaborated on how enterprises should carry out patent protection and patent utilization. His speech provided a new set of working ideas and methods for many people in the IP industry.
Mr. Wang Yongwen, partner of Shenzhen Johnson Intellectual Property Agency (General Partnership) shared with rich and specific cases on how to obtain and defend intellectual property rights. In the cases about obtaining patent rights, he introduced how a foreign company can obtain patent rights in China, what is provisional protection and how to break the monopoly of prior application. In the cases about defending patent rights, he introduced how to defend invention patent rights and the solutions to patent invalidation for the defendant, the procedure of administrative proceeding if not satisfied with the invalidation decision, and how to regulate the publicity behavior of both the plaintiff and the defendant in the litigation to prevent unfair competition. His speech provided comprehensive and specific answers to the patent problems faced by many enterprises.
Ms. You Jing from TSUTSUI & ASSOCIATES gave a presentation on the new developments in Japanese design law and trends in practice. She explained three aspects in detail: the comparison of the intellectual property system in China and Japan, the development of Japanese design patent law and some key points of applying for design applications in Japan.
Many famous media on the scene reported the forum’s grand event. At the same time, tens of thousands of online viewers followed the forum simultaneously and hundreds of online and offline viewers from various parties enthusiastically expressed their opinions while listening to the speeches, adding the lively atmosphere to the forum.
The International Forum on Technology Innovation and IP Protection (TIIP) has been successfully held for five years. Even in the midst of the epidemic, people in the IP industry are still going beyond and forging ahead. It is the wish of the hosts that the success of this forum will bring the IP industry to a higher level, and that the concept of science, technology and innovation will become more deeply rooted in people’s hearts!
